Terms of Use (AGB)

1. Scope and Operator

These Terms of Use (“Terms”) govern the use of the TinyTrekkers website at tinytrekkers.deand the TinyTrekkers mobile application (together, the “Platform”). The Platform is operated by the individual entrepreneur named in the Impressum. By creating an account or otherwise using the Platform, you agree to these Terms.

2. The Platform Is a Marketplace, Not a Rental Party

TinyTrekkers is a peer-to-peer marketplace that connects parents who own baby and children's gear (“Owners”) with parents who wish to rent it (“Renters”). The rental agreement is formed directly and exclusively between Owner and Renter. TinyTrekkers is not a party to that agreement, does not own the listed gear, and does not warrant its condition, legality, or availability. TinyTrekkers' role is limited to providing the technical platform, payment processing via Stripe, and related booking and communication tools.

3. Eligibility and Accounts

  • You must be at least 18 years old and provide accurate information when registering.
  • Each user may hold one account and is responsible for keeping login credentials confidential.
  • We may suspend or terminate accounts that violate these Terms or applicable law.

4. Listings and Gear Safety

  • Owners must describe gear truthfully, including age, condition, and any defects.
  • Safety-relevant items (especially car seats) must never have been involved in an accident, must not be expired or past the manufacturer's recommended service life, and must not be subject to an active recall. Listing unsafe, recalled, or counterfeit items is prohibited.
  • Owners must be legally entitled to rent out the items they list.

5. Bookings, Payments, and Deposits

  • The rental price, deposit amount, and rental period are shown before you confirm a booking.
  • Payments are processed by Stripe. TinyTrekkers does not store full payment card details.
  • As security for damage, the Renter's payment card is saved at booking via Stripe. No funds are charged or reserved at that point. The saved card may only be charged as described in Section 8; if no damage is reported, it is never charged.

6. Cancellations

Cancellations are governed by the cancellation policy shown during the booking process. Where a booking is cancelled in accordance with that policy, amounts already paid are refunded to the original payment method. Statutory withdrawal rights available to consumers, where applicable, remain unaffected.

7. Handover and Return

  • Handover and return are confirmed through the Platform using the in-app QR handover code.
  • The Renter must return the gear on time and in the condition received, normal wear excepted.
  • Damage, loss, or a missed handover should be reported through the Platform without undue delay.

8. Damage, Loss, and Deposit Deductions

If returned gear is damaged beyond normal wear, or is not returned, the Owner may submit a damage report through the Platform within 24 hours of the confirmed return, including a description and photos of the damage. Where a report is submitted within this window, TinyTrekkers may charge the Renter's saved deposit card up to the deposit amount shown at booking. If no report is submitted within 24 hours, the saved card will not be charged. Charging the deposit card does not by itself settle the matter between Owner and Renter: either party retains their statutory rights, and any dispute about the damage or the charged amount is between Owner and Renter directly. TinyTrekkers executes the deposit process described here but does not adjudicate the underlying dispute and is not liable for the damage or loss itself.

9. Reviews

Owners and Renters may review each other after a completed rental. Reviews must be truthful and based on an actual transaction. Fake, manipulated, defamatory, or retaliatory reviews are prohibited and may be removed.

10. Liability

TinyTrekkers is liable without limitation for intent and gross negligence, for injury to life, body, or health, and under mandatory statutory provisions, including the German Product Liability Act (Produkthaftungsgesetz). For slight negligence, TinyTrekkers is liable only for breach of a cardinal (essential) contractual obligation, and then limited to the foreseeable damage typical for this type of contract. TinyTrekkers is not liable for the condition, safety, or legality of listed gear, or for the conduct of Owners or Renters — that responsibility rests with the respective user. Use of rented gear is at the Renter's own risk and responsibility.

11. User Conduct

Users must not:

  • circumvent the Platform to avoid fees for a rental arranged through it;
  • misrepresent their identity, their listed gear, or a review;
  • use the Platform for any unlawful purpose; or
  • harass or discriminate against other users.

Violations may result in listing removal, suspension, or account termination.

12. Indemnification

To the extent permitted by law, users agree to indemnify TinyTrekkers against third-party claims arising from their breach of these Terms, their listing, or their conduct as an Owner or Renter.

13. Suspension and Termination

TinyTrekkers may suspend or terminate an account for breach of these Terms, suspected fraud, or a safety risk to other users (for example, a recalled car seat listing), providing notice where reasonably possible. Users may close their account at any time, provided any open bookings are first resolved.

14. Data Protection

Our handling of personal data is described in the Privacy Policy.

15. Changes to These Terms

TinyTrekkers may update these Terms for legal, security, or operational reasons. We will notify existing users of material changes in the app or by email with reasonable notice before the changes take effect.

16. Governing Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection provisions of the law of the country in which a consumer habitually resides remain unaffected and take precedence where more favorable to the consumer.

17. Severability and Contact

Should individual provisions of these Terms be or become invalid, the remaining provisions remain in effect and are to be interpreted to achieve the closest valid equivalent to the original intent. For questions about these Terms, contact info@tinytrekkers.de.
